On 31st March 2009 the fixed penalty scheme is widened to incorporate offences relating mainly but not exclusively to the use of commercial vehicles - including drivers hours and recording equipment offences, operator licensing and community authorisations. VOSA officers will for the first time be able to issue fixed penalty notices to commercial vehicle drivers. In addition a new scheme of graduated penalties is introduced for specified offences which will vary the penalty according to the severity of the offence - in particular for drivers hours and excess weight offences. A new financial deposit payment scheme is also introduced which will enable police and VOSA enforcement officers to require offenders who cannot supply a satisfactory UK address to pay an immediate deposit in lieu of a fixed penalty, or pending a court hearing. If they fail to pay there are new powers to immobilise the vehicle - these immobilisation and removal powers also extend to vehicles which have been prohibited under other powers such as for being unfit, overweight or where the driver was in breach of his hours requirements. |
